Still, considering the current situation between Muslims and infidels who are not people of the book, as for a peace treaty between them, there are two maximal and moderate views among the jurists of Islamic schools of thought. The early scholars consider jihad with infidels who are not people of the book to be obligatory until they convert to Islam or are killed. They do not allow the conclusion of a cease-fire agreement with them except in case of necessity. But some of the later scholars consider it permissible to fight only with infidels who are sedition seekers, aggressors, and treaty breakers and believe that it is permissible to make peace or remain on a compromise agreement with non-seditious infidels and non-treaty violators who want peace and a peaceful life with Muslims. The latter view is more consistent with the totality of Islamic teachings. Therefore, in this research, while presenting the reasons for the former view and its criticisms, the latter view has been proven by citing several reasons from the Quran, hadiths, and traditions.}, keywords = {Peace,Infidel,People of the Book,People of Dhimma,Muslim}, title_fa = {صلح با کفار غیرکتابی از دیدگاه فقهای مذاهب اسلامی}, abstract_fa = {آرامش و صلح میان انسان‌ها یکی از آموزه‌های آرمانی اسلام است که تعالیم دینی بر آن تأکید کرده است، ولی با توجه به اوضاع و احوال حاکم میان مسلمانان و کفار غیر اهل کتاب، درباره انعقاد پیمان صلح میان آنها بین فقهای مذاهب اسلامی دو دیدگاه حداکثری و اعتدالی به چشم می‌خورد. علمای متقدم جهاد با کفار غیرکتابی را تا زمان اسلام‌آوردن آنها یا کشته‌شدنشان واجب می‌دانند و انعقاد پیمان ترک نزاع با آنها را جز در حالت ضرورت جایز نمی‌دانند. اما عده‌ای از متأخران قتال را فقط با کافران اهل فتنه و تعدی، و ناقضان پیمان جایز می‌شمرند و معتقدند صلح یا باقی‌ماندن بر پیمانِ سازش با کافرانِ غیرفتنه‌گر و ناقض پیمان که خواهان صلح و زندگی مسالمت‌آمیز با مسلمانان‌اند جایز است. دیدگاه اخیر با مجموع تعالیم اسلامی تطابق بیشتری دارد. از این‌رو در این پژوهش ضمن مطرح‌کردن دلایل دیدگاه نخست و نقدشان، دیدگاه اخیر با استناد به دلایل متعددی از قرآن، روایات و سیره به اثبات رسیده است.}, keywords_fa = {صلح,کافر,اهل کتاب,اهل ذمه,مسلمان}, url = {https://mazaheb.urd.ac.ir/article_149085.html}, eprint = {https://mazaheb.urd.ac.ir/article_149085_94aad4ae83a1098b0b1989da2431fa38.pdf} }
