And if there is an inseparability, is it a conceptual, or a concrete and external (or objective) one? Also, is every right necessarily accompanied by an obligation, or are only some rights accompanied by an obligation? Among the thinkers who have addressed this intellectual challenge, “Höfeld” as one of the prominent and authoritative figures in the Western world, and “Ayatollah Martyr Motahhari” as one of the prominent figures in the Islamic world, are two thinkers who seriously and meticulously addressed the elucidation and examination of this issue. The present article, using an analytical-descriptive method, seeks to elucidate, compare, and conduct a comparative analysis of the views of Höfeld and Ayatollah Martyr Motahhari regarding the issue of “the inseparability of right and obligation” and ultimately concludes that while these two thinkers share commonalities in the principles of the issue of the inseparability of right and obligation, they have significant differences in the elucidation and examples of the issue.</span> یکی از مسائل بحث انگیز در میان اندیشمندان فلسفه حق، رابطه حق و تکلیف است؛ بدین معنا که آیا ارتباط حق و تکلیف، ارتباطی اتفاقی و در نتیجه قابل زوال است یا آنکه میان حق و تکلیف، تلازم برقرار است؟ و در صورت تلازم، آیا تلازم آنها مفهومی است یا مصداقی و خارجی؟ همچنین، آیا هر حقی، مستلزم تکلیف است یا تنها برخی حق ها مستلزم تکلیف اند؟ در میان اندیشمندانی که به این چالش ذهنی پرداخته اند، «هوفلد» به عنوان یکی از چهره‌های برجسته و مرجع در جهان غرب و «شهید مطهری» به عنوان یکی از چهره‌های برجسته در جهان اسلام، دو اندیشمندی هستند که به صورت جدی و دقیق به تبیین این مسئله و بررسی آن پرداختند. مقاله حاضر با روش تحلیلی ـ توصیفی در صدد تبیین، مقایسه و بررسی تطبیقی دیدگاه هوفلد و شهید مطهری درباره مسئله «تلازم حق و تکلیف» است و در نهایت به این نتیجه می رسد که این دو اندیشمند هرچند در اصول مسئله تلازم حق و تکلیف با یکدیگر اشتراکاتی دارند، در تبیین مسئله و مصادیق آن اختلافات مهم دارند. https://mazaheb.urd.ac.ir/article_244966_5ff1f176bba3c8f50999b0c4ebad9d52.pdf
